(“Kerivan-Lane,” “we,” “us,” or “our”), a Massachusetts company providing home heating fuel delivery and HVAC services. Through this program, we send automated text messages to customers who have opted in, notifying them of scheduled or in-progress fuel oil or propane deliveries.
2. How to Opt In
To enroll in the SMS Delivery Notifications program, complete the opt-in form. By submitting that form with the required consent checkbox selected, you agree to these Terms & Conditions and our Privacy Policy.
You must be the account holder or authorized user of the mobile number provided, and you must be 18 years of age or older to participate.
3. Message Frequency
Message frequency varies. You may receive text messages when a delivery is scheduled, when a driver is en route, or for other delivery-related updates. The number of messages you receive depends on your delivery schedule and activity with Kerivan-Lane.
4. Costs
Kerivan-Lane does not charge a fee for this SMS program. However, message and data rates may apply depending on your mobile carrier and service plan. Please check with your carrier if you are unsure about your messaging rates.
5. How to Opt Out
You may cancel your enrollment in this program at any time. To stop receiving messages, reply STOP to any text message you receive from us. You will receive one final confirmation message and will receive no further SMS notifications unless you re-enroll.

7. Carrier Disclaimer
Carriers, including but not limited to AT&T, Verizon, T-Mobile, and US Cellular, are not responsible for delayed or undelivered messages. Kerivan-Lane is not liable for messages that are delayed, undelivered, or lost due to carrier limitations, network outages, or other factors outside our control.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Kerivan-Lane shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in this SMS program, including but not limited to missed delivery windows resulting from delayed or undelivered messages.
9. Changes to the Program or These Terms
Kerivan-Lane reserves the right to modify, suspend, or cancel the SMS Delivery Notifications program at any time. We also reserve the right to update these Terms & Conditions at any time. When we make material changes, we will update the “Effective” date at the top of this page. We may also notify active subscribers by SMS. Continued participation in the program after a change takes effect constitutes your acceptance of the updated terms.
10. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
